Off-duty NYPD officer won't face charges in fatal 2025 Orangeburg collision
The New York State Attorney General's Office says the off-duty NYPD officer involved in the fatal Orangeburg collision last December will not face criminal charges.
After an investigation involving interviews with the officer and civilian witnesses, and review of security camera footage, the Office of Special Investigation determined that a prosecutor would not be able to prove beyond a reasonable doubt that the officer committed a crime.
The crash occurred on the evening of Dec. 13 on Route 303 in Orangeburg, when the driver struck and killed 45-year-old William Huertas, of Haverstraw.
Huertas, an employee of the Lowe's located at 206 Route 303 in Orangeburg, was walking across the street after his shift, in the dark, and not in a marked crosswalk when he was struck.
The officer applied the brakes before hitting Huertas, immediately calling 911 and performing life-saving measures.
Huertas was transported to a local hospital where he was pronounced dead.
The name of the officer has not been released.
