An off-duty NYPD sergeant from Warwick is accused of being intoxicated during a wrong -way crash that killed a Peekskill driver on the Taconic State Parkway.
It happened on Jan. 22.
State police say 47-year-old Tiffany Howell was driving south in the northbound lanes in Mount Pleasant.
She crashed head-on into a car being driven by 61-year-old Manuel Boitel, according to the New York State Attorney General's Office.
"We're hoping he still comes home one day but we know that's never going to happen," said Boitel's son, Eric Boitel.
Boitel was driving home from his longtime job as a doorman in Manhattan. News 12 previously spoke to his family.
News 12 spoke with them again on Monday after the New York State Attorney General's Office announced the indictment and arraignment of Sgt. Howell.
"We take some comfort in that it's going to go through the courts and the case is moving forward," said Boitel's son, Marvin Boitel.
Howell faces several charges, including aggravated vehicular homicide.
She pleaded not guilty Monday, according to the New York State Attorney General's Office.
At last check, she was suspended without pay.
The New York State Attorney General's Office is investigating the crash since it involves a member of law enforcement.
Howell is due back in court March 18.
Her attorney told News 12, "No comment."
